In these Terms and Conditions the following expressions shall have the following meanings:

“Product(s)” shall mean any and all the products for sales by Drigar Thubten Dargye Ling in Singapore, abbreviated by DTDL.

“DTDL Dharma Shop" shall mean the online shop managed by Drigar Thubten Dargye Ling, Singapore.

“Terms” shall mean the Terms and Conditions stated on the Website which may be amended and updated from time to time.

All the Product(s) sold by DTDL Dharma Shop through the Website are sold subject to the following Terms and Conditions. By accessing and using any part of this Website to purchase our products, you shall be deemed to have accepted to be legally bound by these Terms and constitute a binding legal agreement between you and DTDL at the time of purchase. These Terms shall apply to all contracts for the sale of goods by DTDL Dharma Shop to you to the exclusion of all other terms and conditions which you may purport to apply under any purchase order, confirmation order, or other similar documents.

DTDL Dharma Shop has the absolute discretion without any liability whatsoever to refuse or terminate the registration of a potential customer for any reason whatsoever.

If you use the Website, you shall be responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. 3. Pricing and Payment

DTDL Dharma Shop shall make every effort to ensure that the price, details, and sizes of the Product(s) are accurate and DTDL Dharma Shop reserves the right to vary the price and other details of the Product(s) without prior notice.

The price of the Product(s) shall be stated on the Website. All prices shown on the Website are in Singapore Dollars. The prevailing rate is the final amount payable for all Product(s) ordered and will be reflected as the nett price in the tax invoice. Payment of the price and tax, if applicable subjected to your local payment/charges term & conditions shall be fully paid when you have checked out and reviewed your order.

If DTDL Dharma Shop discovers an error in the price of a Product(s) you have ordered, DTDL Dharma Shop will contact you as soon as possible. You will have the option to reconfirm your order at the corrected price or cancel it. If DTDL Dharma Shop is unable to contact you, DTDL Dharma Shop may treat your order in respect of the incorrectly priced Product(s) as canceled.

The prices featured on DTDL Dharma Shop are exclusive to the Website.

Prices for some of the Product(s) on the Website may differ from those available for sale at DTDL centre.

The prices featured on the Website are valid and binding when you submit your order and when your order is accepted by DTDL Dharma Shop and no requests for variation or reduction of prices, or application of future discounts offered on the website, will be entertained or accepted by DTDL Dharma Shop.

In the event of any price differentials between the online order billing and final bill whether arising from substitutions, daily price changes, out-of-stock product(s), special price or mispricing, etc. DTDL Dharma Shop reserves the right to adjust the final bill after the online bill is presented/conveyed to you and such adjustment shall be final.

Amendment or Cancellation of your order will not be allowed after the payment is confirmed.

4. General Lien for unpaid goods

Notwithstanding the provisions of the Terms stated herein, without prejudice to any of the remedies DTDL Dharma Shop may have under the common law or statute of Singapore, DTDL Dharma Shop shall be entitled to a general lien on all your Product(s) in the possession of DTDL Dharma Shop for the unpaid purchase price of all Product(s) sold to you by DTDL Dharma Shop under this or any other contract.

5. Availability of stock

If we find that there is insufficient stock to deliver the Product(s) ordered by you, we will notify you as soon as possible and provide an equivalent value Product(s) subject to your acceptance. DTDL Dharma Shop will notify you by email at the address given by you in your order form. DTDL Dharma Shop will not be obliged to offer any additional compensation for the disappointment suffered.

6. Warrants and Liabilities

DTDL Dharma Shop warrants that the Product(s) will at the time of delivery correspond to the description given by DTDL Dharma Shop on the Website. Save as provided in the Consumer Protection (Fair Trading) Act of Singapore, DTDL Dharma Shop makes no warranties, express or implied all on the s sold to you. Any claims for breach of warranties, conditions, or terms must be submitted.

The Terms of this Website shall govern the quality, fitness for purpose, merchantability, and condition of the Product(s). All representations, statements, or warranties made or given by DTDL Dharma Shop, its servants, and agents (whether orally in writing or in any of the brochures, catalogues, or advertisements of DTDL Dharma Shop) regarding the quality and fitness for purpose of the Product(s) or any of the Product(s) shall not be incorporated into the conditions for the contract of sale or the Terms.

7. Delivery of Product(s)

DTDL Dharma Shop will post, or arrange registered mail as specified by the customer, for the Product(s) ordered by you to the person and address you give DTDL Dharma Shop at the time of order. DTDL Dharma Shop shall deliver the Product(s) as soon as possible once payment for the Product(s) has been received. DTDL Dharma Shop shall take at least 10 working days to process your order and payment before making any delivery of the Product(s).

Where the Product(s) are delivered to you as per the shipping tracking to the address as provided at the checkout, the delivery is deemed to have been delivered to such location.

Acceptance of delivery of the Product(s) shall be deemed conclusive evidence of your acceptance of the Terms on this Website. Any variation to these Terms (including any special terms and conditions agreed to between the parties) shall be inapplicable unless evidenced in writing by DTDL Dharma Shop. Subject to the provisions of the Consumer Protection (Fair Trading) Act, after acceptance of the Product(s), you shall not be entitled to reject the Product(s) which are not in accordance with the Terms herein stated or the Website.

DTDL Dharma Shop shall not be liable for any loss or damage howsoever caused due to failure by DTDL Dharma Shop to deliver the Product(s) promptly or within the time herein stipulated by these Terms. Notwithstanding that DTDL Dharma Shop may have delayed or failed to deliver the Product(s) promptly, you shall be bound to accept delivery and to pay for the Product(s) in accordance with the Terms, provided that delivery shall be tendered at any time within [180] days from the date of payment.

8. Title and Risk of the Product(s)

Title and Risk shall pass on delivery of the Product(s).

9. Remedies of Customers who purchase Product(s) from the Website

Where you reject any Product(s), you shall have no further rights whatsoever in respect of the supply to you of such Product(s) or the failure by DTDL Dharma Shop to supply Product(s) that conform to the Terms.

Where you accept or have been deemed to accept any Product(s), then DTDL Dharma Shop shall have no liability whatsoever to you in respect of that Product(s).

DTDL Dharma Shop shall not be liable to you for the late delivery or short delivery of the Product(s).

You may not set off against the Price (including any tax payable if applicable) amounts due from DTDL Dharma Shop whether under the applicable Terms or any other contract of sale or otherwise.

10. Return/Refund Policy

If the Product(s) DTDL Dharma Shop delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, DTDL Dharma Shop shall have no liability to you unless you notify DTDL Dharma Shop via email within 10 days from the date of delivery. If you notify a problem to DTDL Dharma Shop under this condition, DTDL Dharma Shop shall, at its option:

All Customers should examine the Product(s) at the point of delivery or purchase. If the defect or fault existed at the point of delivery or purchase but was not detected or detectable by the Customer’s examination but is later discovered within 1 month of delivery, send an email to DTDL Dharma Shop for review and we will respond on a case by case basis.

You shall not be entitled to a return, or refund, or discount if:-

(1) You damage the Product(s);

(2) the Product(s) was misused and the misuse caused the defect;

(3) the Product(s) was tampered by you or by an unauthorized third party and damaged in the process; and

(4) the defect or fault was caused by ordinary wear and tear.

The buyer shall bear all costs related to the return of the Product(s).

11. Variation of Terms and Conditions

DTDL Dharma Shop reserves the right to amend and update the terms and conditions herein at its sole discretion without prior notice to the Customer. It is your responsibility to review the Terms prior to submitting any order and DTDL Dharma Shop shall have no responsibility to notify you of any changes to the Terms prior to any such change.

Where you have engaged the Website or DTDL Dharma Shop to provide Product(s) and/or services to you, you acknowledge and accept that your personal data may be collected, used, and disclosed by DTDL Dharma Shop to enable DTDL Dharma Shop to properly provide your Product(s) and services to you.

DTDL Dharma Shop will take steps to ensure that the personal data collected from you and used/disclosed by DTDL Dharma Shop are accurate, complete, and up to date.

DTDL Dharma Shop will take reasonable steps to protect your personal data which DTDL Dharma Shop will hold from misuse, loss, and from unauthorized access. 13. Exclusion of Liability

By using and accessing the Website, you acknowledge and accept that the use of the Website is solely at your own risk. DTDL Dharma Shop has no liability or responsibility for any errors or omissions in the contents of the Website. The Website and its contents are delivered on an “as-is” and “as available” basis.

14. Governing Law;

You agree that all matters relating to your access to or use of our Website, including all disputes, will be governed by the laws of Singapore. You agree to the jurisdiction of the courts of Singapore, and waive any objection to such jurisdiction.

15. Dispute Resolution

In the event of any controversy or dispute between DTDL Dharma Shop and you arising out of or in connection with your use of our Website, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If both parties are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit the dispute to mediation upon which both parties will be bound to participate in the mediation.

If the parties decide to submit the dispute to mediation, the dispute arising out of or in connection with this agreement must be submitted for mediation at the Singapore Mediation Centre (SMC) in accordance with SMC’s Mediation Procedure in force for the time being. Every party to the mediation must be (where applicable), represented by [senior executive personnel, of at least the seniority of a Head of Department] or its equivalent, with authority to negotiate and settle the dispute. Unless otherwise agreed by the parties, the Mediator(s) will be appointed by SMC. The mediation will take place in Singapore in the [English] language and the parties agree to be bound by any settlement agreement reached.

If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

16. Third Party Rights

Unless expressly provided to the contrary under these Terms, a person who is not a party has no right under the Contracts (Rights of Third Parties) Act, Chapter 53B of Singapore to enforce or to enjoy the benefit of any condition under these Terms.

Notwithstanding the Terms, the consent of any third party is not required for any variation (including any release or compromise of any liability under) or termination of any concluded agreement or contract pursuant to these Terms.
